Why isn't Narconon Being Investigated by the State of Georgia?

Patrick W Desmond died while under the care of Narconon of Georgia died while under the "care" of narconon of georgia. A candlelight vigil for him was held in July.

It probably would not have happened if the State of Georgia DHR Regulatory Agency had been doing it's job, but it wasn't. There were previous violations that appeat to have been shoved under the rug. How did Narconon get away with these violations from the State of Georgia and remain in operation?

Here is what is on record for Sept 2006 and April 2007. Notice the lack of explanation between the first report and the second.

At the time of the follow-up to the relocation and licensure survey completed May 16, 2006, it was determined that Narconon of Georgia Outpatient Program remains out of compliance with Chapter 290-4-2, Rules and Regulations for Drug Abuse Treatment and Education Programs. Previously cited deficiencies remaining out of compliance were N311, N901, N1003, N1400, N14002, N1405, N1503 and N1504. The following new deficiencies cited were N911, N1008, N1303, N1403 and N1408. N 0311 290-4-2-.03(l) Definitions

In these rules, unless the context otherwise requires, the words and phrases set forth herein shall mean the following: ...

(l) "Outpatient Drug Treatment Program" means a non-residential program staff by professional and paraprofessional persons that provides drug treatment or therapeutic services, primarily counseling and other supportive services for drug dependent persons, and is not classified as an ambulatory detoxification program or
Specialized Day Treatment Program.

This Requirement is not met as evidenced by:

Based on program description, client records, and staff interviews, it was determined that the facility does not meet the definition of an outpatient drug treatment program due to the provision of detoxification services to clients, nor does the facility meet requirements for licensure as a program that includes detoxification due to the facility practice of employing exercise, sauna,
vitamins, minerals and other supplements exceeding the Institute of Medicine recommendations, potentially placing clients' health at risk. Findings were:
The facility submitted an updated application, dated September 13, 2006 for a new license. The program modality request on the application was for outpatient treatment services.

A review of the facility's program description reflected that the facility did not engage in any type of medical detoxification, but further identified that the objective of the program was to assist the client in post-acute withdrawal and rid the body of drug residuals and toxins. The program regimen, in the program description, includes a physical process of withdrawal from toxins and drugs though exercise, sauna, and nutritional supplements. The program description did not specify the amounts of vitamins, minerals, oils, and other supplements, and the extent of the exercise and sauna that were routinely implemented as a part of the purification phase of the detox treatment.

The program used L. Ron Hubbard's "Clear mind-Clear Body" as the protocol for Step 2 of the program, the purification phase. Review of step 2: The Narconon New Life Detoxification Program" directed the program clients though a physical regimen to include: running or walking to increase circulation, monitoring the client's vital signs, using various amounts of liquids, nutrition (in the form of vitamins and supplements) and the sauna to rid the client's body of drug residuals and toxins.
Even though the facility no longer has the sauna located at the facility it continues to prescribe the amount of time the client should stay in the sauna, exercise, and the amount of vitamins, minerals, oils, and other supplements.

Twelve of 12 sampled client records (client #1, #2, #3, #4, #5, #6, #8, #12, #13, #14, #15, and #16) reviewed on 9/12/2006 and 9/13/2006, had no documentary evidence of a physician's order dictating the amount and frequency of chemicals and other supplements prescribed for each client in the purification phase. All 12 sampled records lacked documentary evidence of continued medical oversight to include assessments or laboratory test if required, depending on the clients' changing needs. The client records also revealed that the client files lacked daily
vital signs and exercise times.

The client records also confirmed that the client still discusses the information filled out on the "daily report form" with the facility. The record also revealed that the facility still prescribed vitamins, minerals, oils, and other supplements which far exceeds the Recommended Daily Allowances (RDA).

Review of client admission requirements still indicates that as part of the admission agreement, the clients sign waivers that agree to hold the Narconon program and its affiliates harmless from any and all liability which may arise out of or related to any action of failure to act during the program outlined in the program description. Furthermore, the clients agree to knowingly accept
the risk for any physical, mental, emotional or spiritual damages of any kind that results from participation in the sauna/exercise program and the program's related vitamin and supplement regime that exceed the Institute of Medicine's Recommended Daily Allowances (RDA).

It was determined that the practices of the facility exceed the services allowed in an outpatient drug treatment program, the detoxification program failed to meet accepted standards, and the program description and application failed to accurately designate the ASAM level at which services are provided.
This rule was previously cited on May 16, 2006.

N 0901 290-4-2.09(2) Administration
Program Description. A licensed program shall develop and implement written policies and procedures that describe the range of treatment and services provided by the program and must specify which American Society of Addiction Medicine (ASAM) levels of care will be offered. Such policies and procedures shall describe how identified treatment and services will be provided and how such treatment and services will be assessed and evaluated. A program description must show what services are provided directly by the program and what treatment and services are provided in cooperation with available community or contract resources. The program description shall be reviewed at least annually and updated when treatment or services change.

This Requirement is not met as evidenced by:
Based on a review of the program description, and the program policies and procedures, it was determined the program description did not sufficiently describe the range of treatment and services provided for all clients. The findings were:
The program description specified Narconon of Georgia functioned at an (The American Society of Addiction Medicine) ASAM I level. this level is a outpatient treatment program that does not include a detoxification program. The submitted program description including provided policies and procedures, did not specify the amount of excessive vitamins, minerals, oils, other supplements, and the extent of exercise and sauna time that were routinely implemented as a part of the purification phase of the treatment. The program used L. Ron Hubbard's "Clear Mind-Clear Body" as the protocol for Step 2 of the program, the purification phase.

The facility as of 7/15/2006 no longer does this phase at the facility location, but still does not have the policies and procedures describing the training, qualification and responsibilities of the
staff supervising the purification phase, and how the process would be assessed and evaluated. This rule violation was previously cited on May 16, 2006.

N 0911 290-4-2-.09(7) Administration
A program shall maintain written records for each employee and the administrator. Each individual file shall include:
1. Identifying information such as name, address, telephone number, emergency contact person(s);
2. A ten year employment history or a complete employment history if the person has not worked ten years and at least two reference checks prior to employment;
3. Records of applicable licenses, health requirements, and educational qualifications as required by these rules;
4. Date of employment;
5. The person's job description or statements of the person's duties and responsibilities;
6. Documentation of training and orientation required by these rules;
7. Any records relevant to the employee's performance including at least annual performance evaluations; and
8. For programs serving children, the results of criminal record checks obtained from a law enforcement agency.
This Requirement is not met as evidenced by:
Based on staff interview and record review, it was determined the facility failed to maintain accurate personnel records on the only medical doctor on the staff roster (employee #14).

Findings were:
A list of staff requested from the administrator included one medical doctor. The Narconon of Georgia Organization Chart also referred to the same medical doctor.
No staff record was provided after repeated request for the medical doctor's file from the administrator.
The administrator provided the program's staff schedule and the staff roster that gave a brief synopsis of each staff member. The medical doctor was not on the staff schedule or staff roster from May 2006 through September 2006, even though the same medical doctor is listed on the March 6, 2006 application.

On 9/12/2006 at 2:30 p.m. the administrator was informed of this finding and did not produce any further documentation for the only medical doctor on staff.
N 1003 290-4-2-.10(4) Staffing The medical responsibility for each client will be vested in a licensed physician who oversees all medical services provided by the program. Physician assistants or nurse practioners may be utilized to the extent allowed by state practice acts.
This Requirement is not met as evidenced by:

Based on records review and client and staff interview, it was determined that the facility failed to provide a licensed physician to ensure medical oversight for all client services provided by the program resulting in potential harm for all clients. Findings were:

On day one of the survey, the administrator confirmed at 10:41 a.m. that the sauna was removed from the program, however, client interviews revealed that the facility continued to use L. Ron Hubbard's "Clear Mind-Clear Body" as the protocol for Step 2 of the program purification phase. Review of step 2: The Narconon New Life Detoxification Program" directed the program clients though a physical regimen to include: running or walking to increase circulation, monitoring the client's vital signs, using various amounts of liquids, nutrition (in the form of vitamins and
supplements) and the sauna to rid the client's body of drug residuals and toxins.
Six of six (#8, #16, #17, #18, #19, and #20) client interviews conducted 9/12/2006 and 9/13/2006 reported completing step 2 (sauna):

-#8 admitted 8/1/2006 used the sauna at a person's house;
-#16 admitted 5/28/2006 used the sauna at Narconon;
-#17 readmitted to the program 6/2/2006 used the sauna at a doctor's office;
-#18 admitted 1/23/2006 used the sauna at a doctor's office;
-#19 admitted 7/14/2006 used the sauna at a person's house;
-#20 admitted 5/28/2006 at Narconon; # 20 revealed that they removed the sauna about 2 months
ago (July 2006) and the clients were directed to use the sauna at Ballys, L.A. Fitness, The Church of Scientology, staff members apartment complex and then a person's house. Twelve of twelve sampled client records (#1, #2, #3, #4, #5, #6, #8, #12, #13, #14, #15, and #16) reviewed on 9/12/2006 and 9/13/2006, had no documentary evidence of continued medical oversight to include assessments or laboratory test if required, depending on the clients'changing needs because of the modality of treatment used in the purification phase.

Even though the facility no longer has the sauna on the premises, the program continues to prescribe the amount of time the client should stay in the sauna, exercise, and the amount of vitamins, minerals, oils, and other supplements.
The client records also confirmed that clients still discuss the information filled out on the "daily report form" with the facility. The records also revealed that the facility staff was still prescribing vitamins, minerals, oils, and other supplements which far exceeds the Recommended Daily Allowances (RDA) with potential risk to the clients.

Review of client admission requirements still indicates that as part of the admission agreement, the clients sign a waiver that agreed to hold the Narconon program and its affiliates harmless from any and all liability which may arise out of or related to any action of failure to act during the program outlined in the program description. When queried on September 13, 2006 at 2:00 p.m., the clinical director of the program confirmed that the documentation was not adequate. When asked for further information, the clinical director did not add any additional information.

N 1008 290-4-2-.10(7)(b) Staffing
Additional training consisting of a minimum of thirty (30) clock hours of training or instruction shall be provided annually for each staff member who provides treatment services to clients. Such training shall be in subjects that relate to the employee's assigned duties and responsibilities.

This Requirement is not met as evidenced by:
Based on a review of employee records and staff interview, it was determined that the facility failed to provide 30 hours of training for five of eight sampled employees who worked at the facility for more than a year (employees #1, #3, #5, #11, and #12). The findings were:

Seven of eight personnel records did not have documentation of thirty hours minimum of any treatment related training.
Employee #1 had 18 hours of training.
Employee #3 had 1 hours of training.
Employee #5 had 10 hours of training.
Employee #11 had 4 hours of training.
Employee #12 had 0 hours of training.
During an interview on 9/12/2006 at 2:00 p.m. the administrator was informed of this finding and was unable to confirm that the employees went to training or produce further documentation showing evidence of training on the above mentioned employees' records.

N 1303 290-4-2-.13(1)(b)1. Client Referral, Intake, Assess, Adm
... Physical Assessment. At the time of admission, a preliminary physical assessment shall be done, at a minimum, by a Registered Nurse or Licensed Practical Nurse under the supervision of a RN or physician and shall include documentation of vital signs, appropriate screening tests for STD and TB, urine drug screens, a determination of whether the client requires a physical or psychiatric examination by a physician according to established protocols, and laboratory tests as clinically indicated. Laboratory tests required upon admission for clients in each program modality, in addition to those tests required for all modalities, will be determined by the
programs and documented in their policy and procedures as to the criteria used to determine and specify which minimum lab tests are to be done for each modality. Other lab tests may be required by the physician as clinically indicated. If an examination by a physician is indicated, arrangements shall be made for such an examination as appropriate. The assessment shall also include circumstances leading to admission, mental status, support system, psychiatric and medical history, risk assessment for HIV, history of use of drugs, including the age of onset, duration, patterns, and consequences of use, family history of drug use, route of administration and previous treatment. If a client has been referred for treatment from another facility, the results of a physical examination and laboratory tests from the other facility may be documented and used to assess physical status,
provided that such physical examination was done within six months of admission, and there has been no significant change in the physical status of the client. Further assessments or laboratory tests may be required depending upon the modality of treatment needed or the client's changing condition. ...
This Requirement is not met as evidenced by:

Based on client record review and staff interview, it was determined that the facility failed to do a complete client physical assessment at the time of admission for four of 12 sampled client records (clients #1, #4,#12, and #16)Review of client records on 9/12/2006 and 9/13/2006, revealed :
Four of 12 sampled records (#1, #4, #12, and #16) did not have documentation of a urine drug screen being done at the time of admission. A baseline urine screen test is required to determine specific drug use and to have a guide for measuring improvement or effectiveness, on random future drug screens, in the clients' drug treatment program.

Client # 1's admission date was 5/6/2006 and the urine drug screen test was done on 5/30/2006.
Client # 4's admission date was 7/31/2006 and the urine drug screen test was done on 8/2/2006.
Client #12's admission date was 7/27/2006 and the urine drug screen test was done on 8/4/2006.
Client # 16's admission date was 7/14/2006 and the urine drug screen test was done on
8/24/2006.
When queried on September 13, 2006 at 2:00 p.m., the clinical director of the program confirmed that the documentation was not adequate. No further information was available.

N 1400 290-4-2-.14 Individual Treatment Planning
A program must develop and implement a complete individualized treatment plan for each client. Such treatment plans shall be modified and updated as necessary, depending upon the clients' needs.
This Requirement is not met as evidenced by:
Based on client record review and staff interview, it was determined that the facility failed to develop and implement a complete individualized treatment plan for 12 of 12 sampled clients
(client #1, #2, #3, #4, #5, #6, #8, #12, #13, #14, #15, and #16). Findings were:
Review of client records on 9/12/2006 and 9/13/2006, revealed that all 12 sampled client records did not have individualized treatment plans. All 12 sampled clients had the same three pre-printed objectives written in their treatment plans. The objectives were:
1. Regular attendance at Narconon of Georgia.
2. Provide negative drug screens.
3. Participate in training routines.
During an interview on September 13, 2006 at 3:00 p.m., the administrator was informed of this finding and admitted the facility did not individualize client treatment plans.

Review of client records on 9/12/2006 and 9/13/2006, revealed that all 12 sampled clients' records contained the list of abused drugs (example: methadone, cocaine, etc.) and did not contain the descriptions of the clients' problems.

Review of client records on 9/12/2006 and 9/13/2006, revealed that all 12 sampled clients did not have treatment plans which stated the interventions and services the program will provide to help the client achieve the individual goals and desired outcomes. The clients had interventions like "client will sign in/out at Narconon of Georgia one time daily for 60 days."

During an interview on September 13, 2006 at 4:00 p.m., the administrator was informed of this finding and confirmed that the treatment plans did not state the interventions and services the program will provide to help the client achieve their goals. This rule violation was previously cited on May 16, 2006.

N 1408 290-4-2-.14(c) Individual Treatment Planning
Progress Notes. A program shall document the services received by the client and document chronologically observations of the client's clinical course of treatment which includes the client's response to treatment and progress towards achieving individual goals and desired outcomes. Progress notes shall be documented by the
staff members assigned primary responsibility for the client's care, and shall be legible and recorded in the client's plan. Progress notes shall be recorded as applicable;

1. at the end of each shift in the client's medical record for residential detoxification programs; or
2. following any contact with a client undergoing ambulatory detoxification or narcotic treatment; or
3. at least weekly for substance abuse treatment residences; or
4. daily for day treatment programs; or
5. whenever there are face-to-face contacts with the client for outpatient drug treatment programs; or
6. whenever the client is observed to engage in a behavior which may effect a change in the treatment plan.

document the services received by the client in progress notes for 12 of 12 sampled clients

Review of client records on 9/12/2006 and 9/13/2006 revealed, that the notes in the clients'records did not document, chronologically, observations of the clients' clinical course of treatment which included the clients' response to treatment and progress towards achieving individual goals and desired outcomes.
Interview with the administrator on 9/12/2006 at 2:30 p.m. confirmed that the progress notes were incomplete.

N 1503 290-4-2-.15(c) Medications
Medications. ... Such policies and procedures shall include the following:
(c) Unless self-administered, all medications are administered by a physician, physician's assistant, or nurse. ...
This Requirement is not met as evidenced by:
Based on review of client and employee records, and a statement overheard, it was determined that the facility failed to have medication administered by a nurse for 12of 12 sampled clients
(client #1, #2, #3, #4, #5, #6, #8, #12, #13, #14, #15, and #16). Findings were:
Review of client records on 9/12/2006 and 9/13/2006, revealed that the clients' records did not have any documentation that the vitamins and minerals were dispensed by a nurse. The clients'daily report forms and interviews with clients revealed that the clients are being given vitamins and minerals as a part of their daily regimens. At least one of the twelve sampled clients stated that he/she was on medication prescribed by a physician.

On 9/12/2006 at 2:00 p.m. the surveyor overheard that the staff needed the key to the safe so they could get a clients' medications. There was no nurse at the facility to dispense medications on 9/12/06.

(d) Any medications prescribed, administered or self-administered under supervision are documented on an individual medication administration record that is filed with the individual treatment plan, unless maintained as a clinical record at the client's bedside or in the medication room in a residential detoxification setting. The record must include:
1. Name of medication;
2. Date prescribed;
3. Dosage;
4. Frequency;
5. Route of administration;
6. Date and time administered; and
7. Documentation of staff administering medication or supervising self-administration. ...

Noelle North, Scientology & Subway Sandwiches

Over at RoanOC's YouTube Channel we find one of the top 10 damning videos documenting the truth about the Church of Scientology, it's prejudices and it's "celebrity" members to hit the internet this year. Roan writes:

"Here is Noelle North implementing Scientology's "Jim Crow Law" brand of bigotry in Los Angeles. Noelle has tried to bar Anonymous with their little kids from coming into Subway Sandwiches for a bite to eat. "

I might add that Subway seems to be unwilling to face the ugliness of this matter. Subway refused to preserve their video tape of the incident. However, this videotape posted by RoanOC shows that the sign was indeed taped inside the store window, contrary to the official response.

Scientology and it's Dangerous Front Groups

Recent Scientology Related Deaths

There have been two known recent deaths of Scientology front group program participants. One was a Narconon 'student' the other was a Criminon 'student'. Both were on the Hubbard's drug rehabilitation steps when they died. Both were loved and lost their lives at the hands of scientology practices. Both were situations of preventable negligence. Both are being investigated.

THE DEATH OF PATRICK W. DESMOND



July 11 marked the one month anniversary of the negligent and avoidable death of a well loved guy named Patrick "Rico" Desmond who died while under the supervision of Narconon of Georgia while on their rehab program. A candle light vigil service was held and video taped in front of the Church of Scientology of Georgia to recognize this terrible loss:

'STUDENT' COMMITS SUICIDE DURING CRIMINON DRUG REHAB DETOX

CODY BATES hanged himself at the San Francisco SBDC New Life Center Criminon facility on August 27, 2008. He'd been admitted to the facility on August 24th and began detox the next day. During the first day of detox, he had been administered medication with known side effects that included suicidal ideation to help facilitate the detox. Cody's mother thought he was under medical care and asked SBDC New LIfe Staff to provide 24 hr suicide watch of Cody because of statements he made to staff indicating he might commit suicide. The staff promised to keep a watchful eye but did not follow through and Cody was found on the 27th to have committed suicide. Apparently there was no medical personnel at the facility either.

Here is legal complaint filed by the victim's mother. I hope she sues the hell out of them:


Cody's mother is suing for negligence and wrongful death among othere things, and rightfully so. Her lawyer has been informed of the fact that the facility is not licensed by CA ADP despite the Association for Better Living
and Education (ABLE) press release about this place ( one of 5 or so 'facilities' operated in Single Room Occupancy Hotels in the City of San Francisco.)

Give Me Back My Scientology Confessional Folders & Tapes!

Actor Jason Beghe wants his confessional and other scientology records, folders & tapes back. I want mine back, too. We are not alone in this desire. Why would Scientology want to keep records of us having told our most deepest and darkest thoughts of the past. to what was supposed to be a confidential counselor, when we don't belong to 'the church' anymore? As former members of the cult of Scientology, we are not unlike victims of the techniques described by Joost A. M. Meerloo in his excellent report called Rape Of The Mind




Beghe informed Operation Clambake Message Board aka Xenu.net that he wants all his folders back and that his request to the infamous Celebrity Center International was artfully ignored. So he wrote the Big Kahuna Cult leader David Miscavige and posted it.

There is no moral reason for the church to keep them, but keep them they do. I have been out for 12 years now but I invested 18 years of my life believing that L Ron Hubbard was teaching truth when it was all empty lies. The evolution of Scientology Celebrity Centers was planned by Hubbard many years before but thy needed a certain amount of credible & willing top celebrities to do all the media push. Tom Cruise came along and with others, Celebrity Centers rapidly grew. At one time, I was a member of the Celebrity Centers and treated like a celebrity because my husband was a "celebrity". Back in the 70's and 80's, the pressure was not on celebrities to push scientology but as the years went on and the membership of high end talent began to flow in, these newbies were sectioned off from the minor celebrities and had their sessions videotaped on a steady basis. I spent many of my years there during the days when they couldn't afford toilet paper, much less any video equiptment.

Although all scientologists were given the impression or told that the their secrets were confidential, many found out the hard way that scientology likes to keep the folders to use the contents as a tool to keeping the member from leaving or speaking up. So, the the evidence is overwhelming that confidentiality is just not true. For celebrities who have left the fold, like Nicole Kidman, the is a real fear that your private thoughts could wind up on the cover of The Enquirer or People Mag.

Celebrity artist former Scientologist OT VIII Michael Pattinson explains in explains how celebrities are treated and what happened to him after he left.

Thankfully, we have Jason Beghe broaching this important subject by asking for all the documentation of his life in Scientology to be returned to him. Will he get them? I woul;d hope so but he will have to go to court to force the issue. He should, however, know that there will be many others, including myself, who would join him in a class action law suit in order to get them back.

We were lied to. We were conned. It's a matter of dignity. Getting back as much of one's investment in the past as possible is what any victm want and we victims of Scientology are no exception.

Today Tonight is 'an Australian tabloid current affairs program, produced by the Seven Network at Yahoo in competition with rival Nine Network program A Current Affair.'

French Scientologist and PR / 'black PR ' cult spokesperson, Karen Pouw, is working very hard lobbying the french gov't to get it's cult status whitewashed. Certainly keeping the press away from the Anonymous movement and the Martine Boublil kidnapping story is a priority.

There was a flap at one point when Miss Emmanuelle Mignon, the new Office Director of the presidency at l'Elysée, made mention in a speech that some groups labeled cults like Scientology were really not cults. This caused an uproar in France, and as Roger tells it, she wasn't informed correctly and is now corrected on the matter.

Pouw thought she had a win on that one but ss former church of scientology of Lyon France executive now critic Roger Gonnet stated:

"The story about Emmanuelle Mignon, the Office Director of Sarkozy, whom I visited for more than an hour some weeks ago after her declaration, as Pouw said, is now totally false indeed, here is the story that I know very well. Miss Mignon was'nt informed correctly 'from under', and did ignore a lot of facts about cults when she pronounced the sentences. Just after her unchecked speech about scientology and cults (two very short sentences where she said "Cults are a no-problem, that she denied having said, and "regarding Scientology, I don't know them, but one can wonder"), three TVs, four radios and some newspapers interviewed me about what she said. I thought what was the best solution, being certain that she could'nt have pronounced these sentences if she had known, I decided to say that I'll ask her a rendez-vous. I did two days later and got an answer very fast; I met her more than an hour along on a friday evening, with not the least interruption, announcing her that on saturday, she would find a great article also in the media - that was the Boublil affair. I let her my book 'La Secte' " for further information.

Pouw is very wrong saying that the climate changed, since as soon as Miss Mignon had said this erroneous utterance, medias exploded of articles insisting on her wrongness and on the cults problems. The president was immediately alerted and said that the cults WERE a real problem, and the Prime Minister announced that the MIVILUDES ways would be reinforced."

So, Scientology is widely considered a cult in France. The people there have access to their representatives so a protest is not necessarily a need to gain their attention, as it is here in the US where reporter Emmanuelle Richard was unable to get a quote about Anonymous' concerns about the cult of Scientology from ANY politician in the US for her article which came out yesterday on the Anonymous v
Scientology issue in the USA in the mainstream french publication Liberation:

So, while the Anonymous movement in France appears to be small, the viewpoint among
the french people is that Scientology a cult is widespread.

Here are some quotes from Ms. Richard's blog piece, which includes parts of her article that did not make it into Liberation piece. This gives a good picture of the situation here in the USA vs France in the need for people to protest loudly and anonymously:

Here's how French Anons explain the lack of involvement in the usually demonstration-happy France: this is due to the English-only (until very recently) content on Anonymous' main websites and forums and the fact that "Scientology is just not visible in France," according to a young computer guy and key French Anon.

When a cult is recognized as such in a country, "people don't have the same motivation [as in the U.S.] to fight for the cause." A point worth mentioning: CoS opponents such as Nono Le Clown seem to be able to line up meetings with elected officials "of different parties" to express their concerns about Scientology.

Getting to talk to your representative about Scientology is another story in the United States, and I wish this aspect could have been mentioned in more detail in the Liberation article. I contacted several lobbyists, politicians who have a reputation for being weary of cults, and the American Psychiatric Association (Scientology is actively fighting against psychiatry) and they either all declined or ignored my requests for comments for this article. "Many elected officials and religious leaders are afraid to say publicly what they tell me privately: some of them tell me that they've already been intimidated by the Church of Scientology," said Rev. John Wetzel, a critic who acts as a de facto unpaid "representative" for Scientology detractors in Washington. Arnie Lerma, a former CoS member turned
opponent is more blunt: "We’re fighting in guerilla warfare style because there is no courage in Washington.” [..]

Indeed it's a war and we are winning it by perseverence and getting the facts out to the public.

However, there is work to be done to dispell the image David Miscavige and Karen Pouw are trying to fix in the minds of those they try to influence on behalf of Scientology. Let the people of France know how important Anonymous is in helping unmask the business practices of the cult of Scientology by reading Emmanuelle Richard's blog and article in Liberation and commenting your postition. As well, let the US government representatives know you want them to take a stand against and investigate the dangers of The Church of Scientology and it's the exempt status. "The Lighthouse Letter" tells the story of families torn by the COS's policy of disconnection.

Ida Camburn, 85, was disconnected by her son over thirty years ago. An active critic of the organization's policy of disconnection, she is beloved by the many individuals and families she has strengthened, comforted, and inspired throughout the past three decades.

Ken and Grace Aaron have not heard from their son Zach in ten years. They have not asked that he leave the Church; only that he break his long silence and communicate with them.

Jenna Miscavige-Hill, Kendra Wiseman, and Astra Woodcraft are young women who braved the Church's disconnection policy, and remain separated from many loved ones inside. They came together to form a web community of support for ex-scientology kids.

Tory "Magoo" Christman, aka "Wise Glasses Lady," left the CoS in 2000, leaving behind three decades of family, friendship, and devotion to the organization. She has been a guiding star for Anonymous, urging non-violence and persistence in seeking its aims.

On April 12, 2008, Anonymous will take a stand with these individuals and others, to engage in peaceful protest of the COS's policies of disconnection.

As NBC gears up for fall, no doubt full of hope that it can avoid a third consecutive season as the fourth-place network, you're likely to see a lot of familiar faces plastered on the sides of buses: Meredith Vieira, Brian Williams, Steve Carell, Donald Trump. One face you won't see, however, belongs to a 27-year-old community college dropout from Portland, OR, who is responsible for an NBC ratings phenomenon that has eclipsed or matched those stars' shows: His cunning idea, which makes for endlessly watchable and deeply nauseating television, regularly doubles Today's audience, draws more viewers than both the Nightly News and The Office, and nearly tied The Apprentice in audience last season, a tonic that NBC desperately needs as it founders in the ratings.

His name is Xavier Von Erck, and the program he helped create is "To Catch a Predator," the recurring special "investigation" into the sexual depravity of drooling, sweaty creeps that periodically hijacks Dateline NBC during sweeps months. Xavier Von Erck—if the name sounds invented, that's because it is, but more on that later—is the founder and public face of Perverted Justice, an all-volunteer online organization that seeks to expose adults who troll chat rooms looking for youngsters to have sex with. Its members do this by posing as 12- or 13-year-olds online, engaging in sexual banter with older men, setting up meetings purportedly for sex, and then, after verifying a target's identity, posting his name and personal details online and encouraging readers to call his family and employer to let them know what he's been doing with his free time.

But it's not only predators who have found themselves duped and publicly disgraced by Von Erck. He once set out to destroy an enemy by posing as a woman, seducing him online with graphic sex chats, posting the transcripts on the web, and threatening to release a purported video of his target masturbating—not the kind of behavior you'd expect from NBC News's golden boy.

Von Erck, who previously worked tech support jobs, launched Perverted Justice in 2003. "I was a chatter in the Portland Yahoo regional rooms," he tells Radar in an e-mail. "I, like many, had the notion that individuals going online to solicit kids would be arrested, that cops were all over the chatrooms monitoring things. However, week after week passed and the same guys who would mass-post things like, 'Any 14-to-15-year-olds in here want to make money modeling?' and other solicitations would still be there. It was disturbing." He figured that if he could pretend to be a kid, he could embarrass the lurkers and make every potential predator paranoid about contacting children online.

Perverted Justice initially limited itself to publicizing the names and contact information of its targets on the website. Eventually, local news crews in Portland and elsewhere began collaborating with Von Erck to set up sting operations—drawing perverts to a rented house, filming them as they approached, and using the footage to scare the shit out of parents during sweeps. It was, at best, a mediocre gimmick suitable for mid-market local news until Dateline hit on the idea that would make "To Catch a Predator" a cultural touchstone: Set up a pompous correspondent inside the house to interview the startled pervs and make them sweat. With smarmy host Chris Hansen onboard, the show takes on the classic elements of Aristotelian drama. First, viewers feel pity for the marks, who slowly come to understand before our eyes that they've just wrecked their lives; next comes fear, enhanced by creepy graphics and hard-to-prove statistics indicating that everybody on the Internet wants to molest your daughter; and finally we experience a satisfying sense of purgation as each sucker is taken violently to the ground by local police waiting outside the house.

Even by the bug-eating, race-baiting, promiscuity-celebrating standards of reality television, "To Catch a Predator" is monstrously exploitative—a Television Age Roman coliseum where freakish criminals are publicly humiliated for bloodsport and ratings. Granted, these are bad men, and it's a good thing they are being stopped, hopefully, from hurting actual children. But they can be stopped—and are stopped all the time by local police stings—without parading them across our television screens for titillated and enraged audiences to gawk at between commercial breaks.

And, of course, "To Catch a Predator" is not reality television. It's produced under the auspices of NBC's vaunted news division, which has gone to unprecedented lengths to secure Von Erck's ongoing cooperation, reportedly paying him in excess of $100,000 per episode for his services, and even giving him, according to one source, a cut of any revenue from future DVD sales of the shows. That arrangement, and the show's sensationalism, make some at the network squirm.

"I think it's fascinating television," says one former NBC News producer who loathes the show but often can't look away. "Although I find myself rooting for the pedophiles."

Not much is known about Von Erck's background. He's cagey in interviews—he agreed to talk to Radar only via e-mail—and doesn't reveal much personal information for fear of being targeted by one of the men he has exposed. He was raised in Portland by his mother, who struggled to support the family by working odd jobs—from Taco Bell to a gas station—and moved 12 times before his junior year of high school. He was the captain of his high school's mock trial team, and he continues to demonstrate a facility for debate and rhetoric on his blog, Angry German, where he alternates between charming posts about his love of Portland, video games, and professional wrestling, and vicious, unhinged screeds against various targets. Some of Von Erck's rants betray a hint of the sadism that informs "To Catch a Predator." After a spate of kidnappings and beheadings in Iraq in 2004, Von Erck wrote that he was "positively appalled at Nicholas Berg," who "kneeled meekly and struggled naught [sic] as his death was thrust upon him ... bending to the will of the kidnappers." He was even more enraged by the "shameless and pathetic" conduct of Kim Sun-il, a kidnapped South Korean translator who appeared in a video released by Iraqi insurgents (he was later beheaded). "The asshole, yes, the asshole, screamed in English, pleading for his life," Von Erck wrote. "Let me be the first and probably only American to wish for his speedy death.... No life of such a worm, a coward, can be considered important." Of 9/11 conspiracy theorists, Von Erck had this to say: "I wish I could fucking kill 9/11 conspiracy theorists. Yes, kill. I'd like to kill them. Kill them all... I want you to die. I wish you would die. Why don't you die? Just die."

Von Erck's birth name is Phillip John Eide. Although he legally changed it earlier this year in a Portland court, he says he has gone by Xavier Von Erck since he was 15. Erck is his mother's maiden name, to which he added the "Von" in a nod to his German heritage. "Xavier" he just picked. "My old name was the name my father gave me," he says. "Being that my father had no role in my upbringing, as a teen I did not see the logic in being stuck with his name. So I took my mother's name as a tribute to her, and a new first name." (In the Perverted Justice world, where anonymous volunteers going by handles like Epiphany and Peppermint Patty pretend to be children online, identity is a tricky thing to nail down. Von Erck's longtime friend and roommate, formerly known as Nicholas Wilkins, has also legally changed his name to his online handle, Phoebus Apollo.)

Von Erck briefly attended Mt. Hood Community College before dropping out in the face of what he called a "productive Internet addiction." He then worked various tech support jobs while building up Perverted Justice; now, running the website and coordinating Perverted Justice's role in the Dateline busts is his full-time job. As for how and why he made a career of humiliating perverts, Von Erck is demure: "The site has grown and evolved because people have come to it and suggested ideas, come up with technological improvements, etc. I just organize and direct it. I try not to take credit for the site succeeding, the credit goes to how pervasive the problem is online and how dedicated people are toward fighting it."

Nevertheless, Perverted Justice has many enemies. There are websites devoted to attacking Von Erck and his nameless volunteer corps, and to outing and identifying the people who conduct Perverted Justice's stings. These anti-PJ activists describe themselves as combating vigilantism and what they see as the group's entrapment tactics.

According to an account posted by Von Erck, one of Perverted Justice's fiercest critics was a 44-year-old software developer from Searcy, AR, named Bruce Raisley. Raisley was a frequent poster to a forum at an anti-PJ site called Anti-Vigilante Special Operations (AVSO) and he posted several threatening and seemingly deranged comments to the site. He claimed, among other things, to have written a virus that he would unleash upon Perverted Justice volunteers, and used his computer skills to harass Perverted Justice members by exposing the online handles they used when posing as children and tracking down their real identities. He once threatened, during an IM chat, to "fuck or beat" one Perverted Justice activist if he ever met him (Raisley thought he was communicating with a woman at the time). It's unclear why Raisley, a private pilot and ham radio enthusiast, was so militantly opposed to Perverted Justice. He has claimed he was once a Perverted Justice member but broke with the group after another member found a photograph of Railey's son online and used it in a decoy Yahoo profile—in other words, used his son as bait for perverts. Perverted Justice denies this.

Von Erck claims he contacted local authorities in Arkansas and the FBI about Raisley but they "simply weren't moving fast enough for my tastes, considering how bold he was getting about his threats." So he decided to mete out his own form of perverse justice, introducing himself to Raisley online, via instant messenger.

He called himself "Holly."

Holly and Raisley hit it off. They conducted a months-long correspondence via IM, and gradually, Raisley fell in love with his new online pal. Holly would occasionally inquire about Raisley's anti-Perverted Justice activities, but eventually the conversation turned to sex:

[Raisley]: what r u doing?

[Holly]: I have my fingers in

[Raisley]: i am holding it

[Holly]: are you rubbing it

[Raisley]: r u rubbing your clit?

[Holly]: yes. it feels so good baby

The couple had cybersex twice. Holly repeatedly begged Raisley to masturbate in front of a webcam for her. Raisley told her about his son, his job, his role as a Boy Scout troop leader. Eventually, Raisley came clean to his wife about Holly, told her that they were in love, and declared that Holly was moving to Arkansas. After securing an apartment for the two of them to live in, he went to pick up Holly at the airport. He was carrying flowers.

Von Erck never got on the plane, but he did find someone to go to the airport at the appointed time to snap a picture of a hopeful Raisley waiting for his love to arrive. Then he posted it online, along with the entire text of their chat and a threat to release a video file he claimed showed Raisley masturbating. And then this message to Perverted Justice's detractors: "[W]hen you attempt to threaten members of Perverted-Justice.com... this can happen to you. Tonight, Bruce Raisley stood around at an airport, flowers in hand, waiting for a woman that turned out to be a man. He's not in love. He has destroyed his relationship with his wife, he has denigrated her, and he has betrayed all those around him. He has no one. He has no more secrets. We at Perverted-Justice.com will only tolerate so much in the way of threats and attacks upon us."

Today, Von Erck professes sympathy for his victim. "As much as I hated Bruce Raisley for what he tried to do," he says, "I felt bad for him in the sense that the guy definitely has some mental issues. My hope is that Raisley gets mental health help, he sticks with his wife, and they live a happy, threatening- and harassing-free life. The head game that was played with him was only done in order to 'knock him out' so to speak."

Raisley was indeed knocked out. A call to his home in Arkansas was answered by a woman who said she was his wife. "That was just a big old mess," she said. "He's already lost one job over this, and he doesn't want anybody to know about it. I'm just hoping this will just fade away." Though she would not comment on the accuracy of Von Erck's online account, she admitted having read it.

Von Erck is not the first strange man—and pretending to be a woman for the purposes of seducing a man over a period of months in order to publicly ruin him is nothing if not strange—that NBC News has worked with in order to gather the news. But the extent of the network's business relationship with Von Erck has raised eyebrows in the halls of NBC News.

According to an April Washington Post story, Perverted Justice was paid a "low six figures" consultancy fee to organize a sting operation for Dateline in Ohio. Sources knowledgable about the inner workings of NBC confirm that account, and say NBC is paying the group between $100,000 and $150,000 per show. According to one current NBC News staffer and one former NBC official, the figure was arrived at after Perverted Justice saw the ratings success of its first three Dateline shows and retained the services of Steve Sadicario, a former ABC News executive and agent with NS Bienstock, a firm that represents Bill O'Reilly, Anderson Cooper, and Dan Rather. Sadicario, according to the sources, started a "bidding war" for Perverted Justice's services after shopping an idea for a show to Fox and ABC. NBC won.

The deal that Perverted Justice cut with NBC is unusual in two respects: For one, according to the former NBC News official, it was negotiated by the network's entertainment lawyers, not by the news division's legal staff. Secondly, according to an NBC News staffer, Perverted Justice is entitled to a portion of any revenue from DVD sales of "To Catch a Predator" episodes—an arrangement common in the entertainment world but unheard of in the context of a news division's relationship with a consultant.

The staffer notes, "It would be the first back-end deal in the history of journalism."

It's not hard to see why NBC would go to great lengths to keep Von Erck in its stable, and to ride the "To Catch a Predator" phenomenon as far as it can. So far, the original broadcasts have averaged 9.2 million viewers, beating out such entertainment-division staples as Will & Grace (with an average of 8.6 million viewers last season) and The Office (7.9 million). In the advertiser-friendly 18-to-49-year-old demographic, "To Catch a Predator" episodes ranked 16 among NBC's 41 regularly broadcast shows last season, beating Scrubs and Fear Factor. While it's a special edition of Dateline NBC, rather than a show in its own right, it was one of NBC's few successful new offerings last season. Only Deal or No Deal, Surface, and My Name Is Earl outperformed it in the 18-to-49-year-old demographic.

Both Von Erck and David Corvo, executive producer of Dateline, who submitted to a brief interview and did not return subsequent phone calls, say they are unaware of plans for a DVD, and both say they don't know if Perverted Justice would get any portion of the revenues if a DVD were sold. Sadicario did not return repeated phone calls.

Both NBC and Von Erck declined to discuss specifics of the deal, and Von Erck says that "by and large," he hasn't seen any of the NBC money yet. (He told Willamette Week in May that he'd only been paid $20,000 so far.) But if Perverted Justice is getting paid more than $100,000 per sting, it has earned more than $400,000 since April.

"It was getting expensive," Von Erck says. "We literally could not keep our website up anymore due to the site traffic. At that point it was either no more Datelines or a consultation fee. At the end of the day, the cameramen were getting paid, Chris Hansen was getting paid, the producers of Dateline were getting paid, the police were paying themselves via public funds to do the arrests, the guy who owns the house was getting compensated, the security there was being paid. So it was only natural to seek compensation for the expensive work that we do."

Asked to outline the expenses involved in operating Perverted Justice, Von Erck cites only server costs to handle traffic driven to the group's website by the exposure on Dateline and "confidential" expenses associated with the stings. Perverted Justice has no paid staff and no offices. In fact, it is not even a legal entity. Von Erck says he is in the process of incorporating it as a nonprofit, but claims not to know in which state. Von Erck says he is not personally being paid by NBC and claims not to know precisely to whom NBC is making out the checks.

The arrangement, and the fact that the shows involve cooperation with law enforcement, has some NBC News staff apoplectic. "We've crawled into bed with the cops. People think this will be the pickup truck for the new decade," says one Dateline producer, referring to the notorious episode in 1993 in which Dateline was caught faking exploding gas tanks in GM trucks. "One of these guys is going to go home and shoot himself in the head. The Perverted Justice people are insane, and they'll do something to embarrass us. One of the biggest corporations in the world ought to find a better target than skanky guys in shorts."

"There's no doubt," says another NBC News staffer, "that somewhere down the line, some district attorney is going to ask us for outtakes or footage from a story, and we're going to say, 'We don't do that because we don't want to be an agent of the police.' And he's going to say, 'You did with "Predator." There is a sense [in the news division] that standards don't matter."

Indeed, the network has already been confronted with such a dilemma: In one prosecution that resulted from a Dateline sting, that of Rabbi David Kaye of Rockville, MD, the defense issued a subpoena for the unedited footage of Kaye's conversation with Chris Hansen. NBC's lawyers filed a motion to quash the subpoena, according to Kaye's attorney, in which they signaled their intent to argue that as a news organization they should be shielded from having to reveal the products of newsgathering. But it would be incoherent of NBC to assert its independence when it comes to judicial subpoenas at the same time it invites police officers to participate in its newsgathering efforts. NBC's lawyers quickly realized this and agreed to make the unedited footage available for download on the Dateline website. If the network published it for the world to see, the twisted logic went, it could avoid the unpleasant prospect of defending in court the very principle of independence that it had sacrificed on the screen. (On September 6, Kaye was convicted in federal court of enticing a minor and crossing state lines for illicit sex with a minor.)

It's not just NBC staff that finds fault with "To Catch a Predator." Brad Russ, the former commander of the Internet Crimes Against Children Task Force (ICAC) for Northern New England, a federal program designed to help local authorities fight child pornography and Internet predators, has participated in many online sting operations. "I have a real problem with any citizens' group conducting any investigation into any crime," he says. "It's a mistake for law enforcement to abdicate its responsibility to citizens." And NBC, he says, is playing with fire by drawing potentially dangerous men to residential neighborhoods and confronting them. "How would you feel if the media rented a house in your neighborhood and drew 30 people who've demonstrated a propensity for children to your house? What happens when they flee at a high rate of speed and they T-bone your wife's car? We would never set up a sting in a residential neighborhood." Russ adds that targets could be armed, and that an ICAC officer in Florida was shot and killed during a sting.

Kimberly Mitchell, a researcher for the Crimes Against Children Research Center at the University of New Hampshire, has studied both the efficacy of Internet stings and the risks that children face online. While she says properly conducted stings by law enforcement are a useful tool, she worries that "Predator" overstates the problem. "We've talked to kids, and I think [sexual solicitations online] are something they've come to expect to happen," she says. "It's fairly common for them to see these things and experience them." In fact, according to Mitchell's research, fully two thirds of children who were solicited online last year brushed off the incident, and only four percent of children who regularly used the Internet received "distressing" solicitations. "On the one hand," Mitchell says, "it's good that people are aware. On the other hand, it's blown very far out of proportion—it's extreme. It tells you one small piece of the story. It can distort the truth and present this false fear."

NBC and Perverted Justice are in the process of filming more stings for this season. "They have a whole fresh new bunch for September," says the Dateline producer. "Several weeks' worth. There are a lot of people who would like to see it as a show."

But if initial reports from the unaired stings are any indication, a new series based on "Predator" wouldn't last long. One of the key elements of "Predator" segments is Chris Hansen's "and you won't believe ... " moment, when the predator turns out to be a teacher, a lawyer, a rabbi. It's a message that plays well to the upscale audience NBC caters to. These people could be your neighbors. But according to an NBC News staffer, the stings have become a victim of their own success. "What I heard was that they had a tough time of it," the staffer says. "The smarter predators have figured it out. You're not getting the rabbis, doctors, and teachers. You're getting losers."

And losers, as the former NBC News official put it, "aren't in the demo."

I am your system administrator, the one that has been fighting DDoS attacks for six months now trying to keep this message board and www.rickross.com up and running. I made a posting here yesterday asking for your help, but not many people have seen it there. So I'm repeating it here:

That's why everything is slow and unresponsive right now and that's also the reason why the board was down all of the weekend 7-9 March. The attacker is the same fruit basket that has been attacking www.rickross.com ever since September last year: Bruce Raisley.

After almost six months of this shit, it really has to stop. And the way to stop it is to make the attacks counterproductive for Raisley himself. That's where you can help.
